These Terms of Use govern your use of kinnectd.com and the content on it (the "Site"), operated by Kinnectd LLC, a Texas limited liability company ("Kinnectd", "we", "us"). By using the Site you agree to these Terms. Our products have their own terms: A2Me's are at a2me.app/terms, and Safety Goggles' are linked from the app. When you use a product, that product's terms apply to it.

1. Using the Site

The Site is for people interested in Kinnectd and its products. You may browse it and download or print pages for personal, non-commercial use. You may not copy, republish, scrape, frame or otherwise exploit the Site or its content for commercial purposes without our written permission, use automated tools to access it other than ordinary search engines, attempt to interfere with its operation or security, or use it for anything unlawful. You must be at least 13 to use the Site; if you are under 18, a parent or guardian is responsible for your use.

2. Our content and marks

The Site and everything on it, including text, graphics, logos, images, videos and software, are owned by Kinnectd LLC or its licensors and protected by copyright, trademark and other laws. "Kinnectd", "A2Me", "Ancestors to Me", "Safety Goggles" and related logos are our trademarks. Nothing on the Site grants you a licence to use them.

3. Information you send us

If you contact us, apply to a program, or submit ideas or feedback through the Site, you give us permission to use what you send for the purpose you sent it and, in the case of suggestions and feedback, to use them without obligation to you. Do not send us confidential information you want protected. How we handle personal information is described in our Privacy Policy.

4. Programs and offers

Information on the Site about pricing, features, availability, the ambassador program, partnerships or promotions is informational and may change without notice. Specific programs are governed by the terms presented when you join them. We may correct errors on the Site at any time.

The Site links to third-party sites and services, including app stores and social networks. We do not control and are not responsible for their content or practices.

6. Disclaimer

The Site is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, and do not promise that the Site will be uninterrupted, error-free or free of harmful components.

7. Limitation of liability

To the fullest extent permitted by law, Kinnectd LLC and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages arising from your use of the Site. Our total liability for claims relating to the Site will not exceed one hundred US dollars (USD 100). These limits do not apply where they cannot be limited by law.

8. Indemnity

You will indemnify Kinnectd LLC against claims and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or violation of these Terms.

If you believe content on the Site infringes your copyright, send a notice with your contact details, identification of the work and the material, a good-faith statement, a statement under penalty of perjury that the notice is accurate and you are authorized, and your signature to support@kinnectd.com or to the postal address below.

10. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-laws rules. Any dispute relating to the Site will be brought in the state or federal courts in Dallas County, Texas, and you consent to their jurisdiction, except that either party may bring an individual claim in small-claims court. Any claim must be brought within one year after it arises unless a longer period is required by law.

11. Changes

We may change these Terms by posting the revised version with a new date. Continued use of the Site after a change means you accept it.

12. General

These Terms and the Privacy Policy are the entire agreement about the Site. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms to an affiliate or successor.
